Fayez Ayyoub Arrested On Tax Evasion Charges In Vallejo

A Vallejo tobacco wholesaler has been arrested for allegedly not paying excise tax on tobacco products he purchased in Washington state.

Fayez Ayyoub, 66, failed to report purchasing $567,000 in untaxed tobacco products from the Lil Brown Smoke Shack in Yakima, Wash. between 2009 and 2012, the California State Board of Equalization said Monday.

Ayyoub owes $188,000 to the Board of Equalization, spokesperson Yating Campbell said.

Ayyoub also filed false repots to the BOE, significantly underreporting gross purchases and sales, Yating said.

The five felony charges also contain an enhancement alleging the tax evasion is an aggravated white-collar crime, Yating said.

Yating was booked in the Sacramento County jail under $175,000 bail after his July 28 arrest.

The arrest came after a three-year investigation by the California Tax Recovery and Criminal Enforcement Task Force, Yating said.

Scotts Valley Police Looking For Hit-and-Run Suspect

Police are investigating a hit-and-run Monday night that injured a man in Scotts Valley.

Around 8:25 p.m., a customer was cleaning the front windshield of his vehicle at the Quik Stop gas station at 5400 Scotts Valley Drive when a small black sedan backed into him, according to police.

Police said the driver of the sedan fled the scene without checking on the man he hit.

The victim suffered an injury to his leg.

The vehicle was last seen heading south on Scotts Valley Drive.

Anyone who witnessed the incident or has any information about the vehicle is asked to call the Scotts Valley Police Department at (831) 440-5670.

Eight Plead Not Guilty To Transporting $23m Worth Of Marijuana By Boat In Redwood City

Eight defendants have pleaded not guilty to transporting more than 5,000 pounds of marijuana from Mexico to San Mateo County by boat, prosecutors said today.

The eight defendants who entered pleas are Luis Farid Gonzalez, 20, Juan Hernandez, 39, Juan Valdez Lopez, 50, Luis Espinoza Mendoza, 28, Estaban Flores Salazar, 39, Joan Sicairos, 19, Mark Richard Teixeira, 38, and Phin Yo Vorn, 33. They entered the pleas Monday in a courtroom in Redwood City.

A ninth defendant, Mario Gonzalez, 36, was not able to appear in court and will be arraigned this afternoon, according to the San Mateo County District Attorney’s Office.

The charges against the four Mexico residents, three San Jose residents and two San Diego residents stem from an incident Friday night in which San Mateo County Narcotics Task Force agents intercepted 180 bales of marijuana worth $23 million after they were loaded into vans from a boat that had landed at the beach in Año Nuevo State Park in Pescadero, prosecutors said.

On Friday, officials from the U.S. Department of Homeland Security alerted the county task force that marijuana boats might be landing off of the San Mateo County coast, according to the district attorney’s office.

At 10:15 p.m., two large vans allegedly entered the state park to meet a panga boat that had landed there, prosecutors said.

Task force agents stopped the vans as they drove back onto state Highway 1 and discovered 5,148 pounds of marijuana inside, prosecutors said.

Agents also found an inflatable raft, rain gear and cellphones on the beach. A local fisherman spotted the unmanned boat drifting in the water and the U.S. Coast Guard recovered it, according to the district attorney’s office.

An investigation determined the boat had come from Mexico to deliver marijuana to California, prosecutors said.

The defendants are due back in court on Aug. 14 for a preliminary hearing.

Maria Penaloza, Efrain Lechuga, Javier Betancourt and Araceli Cabrera Charged in Alleged Scam That Stole More Than $700,000 From Latinos

Four San Jose residents have been charged with running an investment scam that bilked Latino residents in San Jose and elsewhere out of more than $700,000, the Santa Clara County District Attorney’s Office said today.

Maria Penaloza, 37, Efrain Lechuga, 34, Javier Betancourt, 52, and Araceli Cabrera, 23, are named in 23 felony counts including securities fraud, grand theft of more than $500,000 and passing bad checks, Deputy District Attorney Victor Chen said.

Penaloza, considered by prosecutors as the ring’s leader and who benefited the most from the scam, faces additional charges that could get her up to 33 years in prison if convicted, Chen said. The members of the ring targeted Latinos in San Jose, Los Angeles, Chicago, Seattle and Texas by promising them profits of 50 to 80 percent in exchange for short-term loans to small businesses, Chen said. The ring led the victims to believe that they were investing in businesses such as “Inversiones Monarcas,” “Gabriela Santana Salon,” and “Centravel” but many of the businesses were merely registered names or storefronts with minimal operations, according to prosecutors.

Cabrera herself took victims to some of the businesses to falsely tell them where their money was going, often asking them for $10,000 and claiming it would turn to $15,000, or a 50 percent profit, in only six months, according to Chen. One of the businesses shown to an investor was a tire store at a storefront but it was only open once a week, he said.

The people taken in by the fraud were naïve, not very sophisticated and trusted the members of the ring, Chen said. The funds received by the scammers “went straight into her (Penaloza’s) bank account” and she used the money to buy luxury items such as BMW cars and vacations, according to Chen. Some victims started coming forward to the district attorney’s office, which sent investigators out to the businesses the people supposedly invested in and found they were barely functioning, Chen said. Most of the investors lost all of their money and some their entire life savings, prosecutors alleged.

In one case, a laborer tearfully told investigators that he lost all of the $30,000 that took him 18 years to save, according to Chen. Penaloza had the investments come due way into the future knowing that she would be gone from the areas where the victims gave her money, Chen said.

She was arrested on July 16 in Bastrop, Texas where she and Lechuga, who is her husband, fled to live with family members, Chen said.

Authorities barely missed Lechuga, who remains at large, when they arrested Penaloza, who will be extradited within days to San Jose, prosecutors said. Cabrera and Betancourt were arrested in San Jose this past week, according to Chen.

Investigators so far have found 17 victims of the ring, most of them residents of San Jose and Los Angeles, who invested more than $700,000 with Penaloza and the ring between December 2012 and June 2013, prosecutors said. The district attorney’s office believes there are other victims who are undocumented and afraid to come forward because they fear deportation, but the office will assist them regardless of their immigration status, Chen said.

San Leandro Police Release Sketch Of Sexual Assault Suspect

Police released a sketch today of a suspect who sexually assaulted a young girl in a restroom in the pool area of a San Leandro apartment complex Saturday.

The pre-adolescent girl was with her family in the pool area of the Lakeside Village apartment complex in the 3000 block of Waterfall Way at about 4:35 p.m. Saturday when she went to use the women’s restroom, police said.

A man attacked and sexually assaulted her once she got into the bathroom. He fled before police arrived.

Police said that the suspect is not believed to live in the apartment complex but either was there visiting someone who does live there or followed someone inside.

He is described as a black man between 19 and 20 years old who is 5 feet 7 inches tall, weighs 140-180 pounds and has tattoos on his arms.

Detectives have been examining forensic evidence, searching for surveillance video and interviewing witnesses to try and track down the suspect, police said.

“We are committed to solving this violent crime and bringing resolution to the survivor and her family as soon as possible,” San Leandro police Lt. Robert McManus said in a statement.

Two Adults And One Teen Arrested In Stabbing Death In Downtown San Jose

Police have arrested two men and a juvenile in the stabbing death last week of a 33-year-old Oakland man who was attacked in downtown San Jose, a police spokesman said today.

Police were dispatched at about 2:15 a.m. last Tuesday to the area of South Market Street and Park Avenue where they found the victim, Michael Maynard, police Officer Albert Morales said.

Maynard, who was attacked by a group of suspects following an argument, died shortly afterward at a hospital from multiple stab wounds, Morales said.

A day after Maynard died, homicide detectives arrested Luis Garcia, 21, and Luis Alvarez, 20, both of San Jose, on suspicion of murder, according to Morales.

On Saturday, officers captured a third suspect, a 14-year-old boy, also of San Jose, police said.

The Police Department is asking anyone with information about the case to call homicide detectives at (408) 277-5283 or to leave an anonymous tip with Silicon Valley Crime Stoppers at (408) 947-7867.

Rachel Smith Arrested After Allegedly Attempting To Stab Father

A Richmond woman is behind bars after allegedly attempting to stab her father when he tried to keep her from leaving the house with her young daughter while drunk, a police spokeswoman said today.

Officers arrested 26-year-old Rachel Smith on suspicion of assault with a deadly weapon and obstructing an officer on Sunday night in connection with the incident, Richmond police Sgt. Nicole Abetkov said.

Smith was at a home in the 3900 block of Jenkins Way with her father and 6-year-old daughter around 7:10 p.m. when she tried to leave with the girl, according to Abetkov.

An argument erupted after Smith’s father tried to prevent her from taking the girl because she was intoxicated, and the suspect allegedly wielded a knife and tried to stab him, the spokeswoman said.

The father was able to defend himself without injury. The child was also uninjured.

Officers arrived on the scene a short time later and took Smith into custody.

While sitting in the back of the police patrol car, the suspect became combative with officers and attempted to kick out the vehicle’s back windows, Abetkov said.

Officers placed the woman in a WRAP – a full-body restraint system similar to a seatbelt – and took her to county jail in Martinez.

Walnut Creek Police Release Photo of Man That Allegedly Stole Package from Doorstep

Police in Walnut Creek are asking for the public’s help in finding a man suspected of stealing a package from a home’s front doorstep on Tuesday evening. The theft, which was caught on a home surveillance camera, happened around 7:10 p.m. at a home in Trotter Court, Walnut Creek police Lt. Steve Gorski said.

Gorski said the man made off with a package containing about $107 worth of diapers and baby formula. He was seen leaving the area in an older gray GMC truck, according to police. Police are releasing a surveillance image of the suspect.

Loran Green-Silveira Arrested In Home For Allged Burglary

Police on Tuesday arrested a man suspected of burglarizing a Morgan Hill home.

Officers responded at 11 a.m. to a burglary in progress in the 18000 block of Murphy Springs Drive, according to Morgan Hill police.

Loran Green-Silveira, 25, of Morgan Hill, was found inside the house possessing stolen property from separate burglaries in Morgan Hill and Gilroy, police said.

Police entered the residence with a police dog and convinced Green-Silveira to surrender.

He was booked in the Santa Clara County Jail on suspicion of possession of stolen property, violation of probation and trespassing.

Morgan Hill police recommend that community members make a list of their valuables, take pictures of the items and note their serial numbers and descriptions in order to help police identify stolen property.

Gwanho Oh Arrested For DUI After Crashing Into Car Dealership In Concord

An Oakland man was arrested on suspicion of driving under the influence in Concord early this morning after driving off of an Interstate Highway 680 off-ramp and into a car dealership, a California Highway Patrol spokesman said.

The crash happened around 3 a.m. at the Concord Avenue off-ramp from northbound Highway 680.

The driver, identified as 24-year-old Gwanho Oh, was heading north on the highway when he veered off of the off-ramp and plowed into some roadway signs, a fence and several parked cars at an Infinity dealership, CHP Officer John Fransen said.

Oh was taken to a hospital as a precaution and was arrested on suspicion of DUI.

Four Teens Arrested In Theft Of Cellphone And Hit-and-Run In Santa Cruz

Four teens suspected of taking part in a robbery of a cellphone that ended in a hit-and-run injury to a Santa Cruz woman early Saturday have been arrested, a deputy police chief said today.

Shortly after midnight Saturday, Santa Cruz police answered a report of a disturbance by a group of people in their late teens in the 1500 block of Laurent Street, Deputy police Chief Steve Clark said.

The four teens, who had just left a party in Aptos and were looking for another party in Santa Cruz, were confronted by a 57-year-old female resident who started taking photos of them on her cellphone, according to Clark.

The teens objected to her actions, assaulted her, took her phone and tried to smash it but the woman was able to retrieve it and resumed taking pictures of the teens after they entered a car, Clark said.

The teens left the area in the car but decided to return to Laurent Street to take the woman’s phone, fearing that their photos would be posted on a social media website, according to police.

The driver of the car, Kyla Bell-Bernard, 18, of the Freedom area of Santa Cruz County, drove the car back to the street and one of the passengers reached out and grabbed the victim’s phone, pulling it and the woman’s arm into the car, Clark said.

The woman fell to the ground and the car drove away, running over the victim’s arm and causing a compound fracture. Police believe that the suspects then threw the woman’s phone into the ocean, Clark said.

Detectives eventually tracked down the four teens and on Monday, arrested Bell-Bernard, Cassie McCabe, 18, of Soquel in unincorporated Santa Cruz County, Esabella Gentile-Montgomery, 19, and Riley Cameron, 18, both of Santa Cruz, on suspicion of robbery and conspiracy, police said.

Bell-Bernard was also arrested on suspicion of felony hit-and-run for being the driver of the car, which belonged to McCabe’s family, according to Clark.

Police said that Gentile-Montgomery and Cameron played active roles in the conspiracy to return to Laurent Street to take the victim’s phone and dispose of it, Clark said.

The victim is recovering from her injuries, he said.

Darrell Waters Arrested After Running From Police With Attempted Murder

An Oakley man suspected of attempted murder is behind bars after fleeing police in El Cerrito last week, authorities said today.

Darrell Waters, 34, was taken into custody last Thursday on a Contra Costa County arrest warrant for attempted murder and for allegedly being a gang member in possession of a firearm, according to police.

Police said an officer attempted to stop Waters after he ran out the emergency door of a restaurant in the 11400 block of San Pablo Avenue around 6:45 p.m.

The man fled the officer, ran into another nearby eatery and tried to hide.

Officers quickly located Waters and arrested him on the warrant and for allegedly resisting arrest. He was taken to county jail in Martinez, where he is being held in lieu of $80,000 bail.

Police and county sheriff’s office spokesman Jimmy Lee said they did not have information about the crimes that prompted a warrant for Waters’ arrest.

Fingerprinting Leads To Burglary Arrest Of Luis Deltoro

Fingerprint evidence led to the arrest of a suspect in a series of auto burglaries at BART stations, police said today.

San Leandro police initially arrested the suspect, 21-year-old Oakland resident Luis Deltoro, for auto burglary on June 21.

Officers from San Leandro then alerted BART officials about the arrest, knowing that they were investigating the same suspect.

BART officials report that fingerprints have now allegedly connected Deltoro to at least three auto burglary cases in BART parking lots at the Hayward, San Leandro and Bay Fair stations.

Due to understaffing, many city police departments no longer dispatch a uniformed officer to the scene of an auto burglary to collect forensic evidence, including fingerprints.

However, BART is still able to perform this service.

BART Police Chief Kenton Rainey says, “At BART, our officers receive specialized fingerprinting and forensic training to better serve our riders who experience car break-ins at BART parking lots.”

To help speed the processing of fingerprint evidence, BART police contract with a forensic specialist.

Chief Rainey says the specialist helps the process take a matter of weeks, instead of months.

Deltoro’s arraignment date is scheduled for Aug. 8 at 9 a.m. at the Hayward Hall of Justice, according to San Leandro police.

Man Arrested For Alleged Craigslist Rental Scam In Hercules

A 21-year-old San Francisco man has been arrested for allegedly setting up a Craigslist rental scam for a Hercules home that was sold earlier this week, police said today.

A woman called Hercules police on Tuesday morning to report that she believed she had been the victim of a rental scam after responding to a Craigslist ad for a four-bedroom home in the 1900 block of Pheasant Drive, Hercules police Det. Connie Van Putten said.

The woman met up with a young man who showed her the home on Monday and said he was managing the investment property for his father, according to Van Putten.

After voicing her interest in renting the house and filling out a credit application, the man asked for a $1,500 security deposit, which she agreed to give at a later time.

Later the woman discussed the rental home with a friend who is a realtor. The friend told the woman that the home was up for sale and not likely for rent, prompting her to call police.

Police said investigators determined that the home’s real owner had sold it on Monday.

Police Tuesday also heard from a second woman who said she believed she had been the victim of a rental scam involving the same home and same suspect, who had asked her to meet him in Richmond Tuesday night to give $1,500 security deposit.

Working with police, the first victim set up a Tuesday night meeting at the rental home, saying she would bring the security deposit.

Police arrived to stake out the house around 8:30 p.m. and saw the suspect drive up and park across the street from the house, then drive away before the victim arrived.

Officers stopped the suspect a short distance away on a traffic violation and with the victim’s help, were able to positively identify him as the man involved in the rental scam.

Inside his car officers found completed rental applications from four different people as well as a ‘For Sale’ sign and brochures that had been taken from inside the home, Van Putten said.

The suspect, identified as Gino Eckstein, was arrested on suspicion of renting property under false pretenses, burglary, possession of stolen property and identity theft. He was also arrested for allegedly committing a felony while out on bail for a prior felony since he was recently incarcerated in San Francisco County Jail on felony charges.

He is being held in county jail in Martinez on $395,000 bail.

Van Putten said police believe Eckstein may have victimized other would-be renters. Anyone who believes they may have been victims of the same rental scam and had contact with a man posing as “Eric” or “Eric Stegner” about renting a house are asked to call Hercules police Detective Pesmark at (510) 799-8223 or Hercules police dispatch at (510) 724-1111.

Kyle Facchin Identified By Sheriff’s Deputies as Alleged Burglar in Surveillance Video-Now a Wanted Man

Contra Costa County Sheriff’s deputies are currently searching for Kyle Facchin, who they say allegedly burglarized a home in Alamo.

He was allegedly identified after surveillance video from the victim’s home was shown on television and the internet.

Zephyr Malik Carter wanted, escaped from Sonoma County Jail

A 41-year-old inmate who escaped from Sonoma County Jail on Monday morning remains at large, a Sonoma County Sheriff’s sergeant said. Zephyr Malik Carter was part of a work crew participating in an agricultural program when he ran from North County Detention Facility around 8:30 a.m. Monday, sheriff’s Sgt. Cecile Focha said.

Carter was outside the secure perimeter and deputies have not determined if the escape was planned or spontaneous, Focha said. He was last seen wearing denim pants and a jacket with the letters “MADF” across the back, Focha said. Carter has ties to Oakland and his last known address was in Hayward, according to Focha.

He goes by multiple aliases including “Christian Carter,” “Freddie Zephyr Smith,” “Marcus Smith,” and “Malik.” Carter is described as a black man standing about 5 feet 10 inches tall and weighing around 200 pounds with a dark complexion, brown eyes and black hair. He has tattoos of a dragon on his right bicep and an angel on his left forearm.

Carter was sentenced to two years and eight months in prison on theft and credit card fraud charges. He was involved in a major fraud ring that included stolen identities, vehicles, drugs and cash at Graton Resort & Casino in April, according to Focha.

Alleged Gang Member Stabbed After Starting Fight Near American High School in Fremont, California

An alleged gang member was stabbed in a Fremont high school parking lot Wednesday night but appears to have started the fight, a police spokeswoman said today. The 23-year-old Fremont man, who police said is a known Norteno gang member, confronted another man who he said was a member of an opposing gang at about 9:30 p.m. near the softball field at American High School at 36300 Fremont Blvd., police Officer Geneva Bosques said.

He punched the other man in the face, provoking the man to pull out a knife and stab the 23-year-old in the leg, Bosques said. The stabber took off running before police arrived. The man with the stab wound was taken to a hospital for treatment of his injuries, which were not considered life-threatening. He is being treated as both a suspect and victim in the case and has refused to cooperate with police, Bosques said.

The man who fled was described as a Hispanic man wearing a white T-shirt, blue jeans and light-colored shoes, Bosques said. He has not been found.

Woman Bound by Robbers While Home with Infant Granddaughter

A woman was bound with duct tape and robbed while home with her infant granddaughter on Wednesday afternoon, according to police. The woman was cooking in her home in the 4200 block of Deep Creek Road at about 2:40 p.m. Wednesday when two men came into the home through an unlocked back door, Fremont police spokeswoman Officer Geneva Bosques said. The suspects grabbed the 55-year-old woman and bound her with duct tape completely covering her nose and mouth, making it difficult for her to breathe, Bosques said.

After she complained, one of the suspects even moved the tape at one point to help her breathe. The suspects went through the home but at some point the woman apparently blacked out, so she did not see what they stole or how they left. The front door was left open, leading police to conclude they fled that way onto Deep Creek Road, Bosques said. The woman eventually woke up still bound and crawled to her cellphone, which was charging, and called a family member. Once police arrived, the woman was taken to a hospital for treatment of minor injuries.

Her 9-month-old granddaughter was not injured. Police are still trying to determine what the suspects stole from the home but it appears the woman’s purse was stolen, Bosques said. The woman does not speak much English, necessitating officers to call a translator to get descriptions of the stolen property and suspects, Bosques said. She said investigators are confident in the suspect description she provided but not absolutely sure it is accurate.

Both suspects were described as Asian men between 30 and 35 years old with black hair, standing 5 feet 10 inches tall, weighing about 200 pounds and wearing short-sleeved white T-shirts. One was wearing a baseball cap, police said. Anyone with information about the case or who may have video surveillance footage of the neighborhood at the time of the incident has been asked to contact Fremont police Detective Blass at Jblass@fremont.gov.

Marvin Garcia 14-Years-Old Charged as Adult in Stabbing Murder in San Jose

Two men and a 14-year-old boy charged in the fatal stabbing of a man in downtown San Jose appeared in court today after prosecutors decided to charge the teen as an adult, according to the Santa Clara County District Attorney’s Office. Luis Garcia, 21, Luis Alvarez, 20, and Marvin Garcia, 14, all of San Jose, were present in Superior Court in San Jose before Judge Sheyna Brown but did not enter pleas to murder charges with gang enhancements, Deputy District Attorney Charles Gillingham said.

After hearing the lawyers for each of the three defendants introduce themselves, Brown agreed with the attorneys to set the next hearing in the case for Sept. 3. Prosecutors allege that the trio took part in the stabbing death of 33-year-old Oakland resident Michael Maynard in the vicinity of South Market Street and Park Avenue in downtown San Jose at around 2 a.m. on July 29. According to San Jose police, Maynard was attacked by a group of suspects following an argument and was stabbed multiple times. He died shortly afterward at a hospital.

Police arrested Luis Garcia and Alvarez on suspicion of murder a day after Maynard’s death and took Marvin Garcia into custody on Saturday.

At least two of the defendants, Alvarez and Luis Garcia, are alleged members of a criminal street gang and prosecutors added the gang enhancement to the homicide charges because they believe Maynard’s killing was tied to gang activity, according to Gillingham.

At the hearing today, Alvarez and Luis Garcia, dressed in red jail attire, sat in the jury box while Marvin Garcia, wearing a green sweatshirt and brown pants and with his hair pulled back in a ponytail, stood by a doorway leading to holding cells for defendants. A lawyer for the county’s Independent Defense Counsel Office representing Marvin Garcia told Brown that the boy is being held at the county’s juvenile detention facility in San Jose.
