Concord School Teacher Takes Stand in Molestation Trial, He Denies Allegations of Inappropriate Behavior

A longtime Concord elementary school teacher testified in a Martinez courtroom today that he never inappropriately addressed or touched any of his students, despite the numerous child molestation charges against him. Joseph Martin, 46, took the stand for the first time in Contra Costa County Superior Court today in the lengthy trial against him, which is expected to wrap up this week. He is charged with 150 counts of lewd and lascivious conduct with 14 male former students at Woodside Elementary School, where he allegedly touched and rubbed boys beneath their shirts on their chests and stomachs, brushed boys’ groin areas and had them sit on his lap.

Dressed in a suit and tie, Martin answered a series of repetitive questions about whether he ever inappropriately touched or spoke to his students with a firm “No.” He told the court that he wanted to create a positive, fun environment for his class and cared deeply about his students, making sure to focus on the ones that had behavior problems or struggled with their schoolwork. Martin testified that he was affectionate with his students, doling out encouraging pats on the back and chest as well as hugs, but only after checking if it was ok with them. “It was a natural part of my teaching,” he said. Under direct examination from his attorney, Patrick Clancy, Martin testified about different times he had touched the purported victims in the case. He sometimes gave backrubs to boys if they requested them and once massaged a boy’s calf because he was sore after basketball practice, Martin testified. Another time, he testified, he lifted a boy up to see if he would be too heavy to carry, and in another instance, he kissed a boy on the cheek while consoling him about his recently deceased brother.

In another incident of alleged inappropriate touching witnessed by a passing teacher, Martin said he had only reached over to catch a boy who was about to fall from a chair in his classroom. However, he repeatedly denied the allegations of many of the purported victims that he put his hand under their shirts and rubbed their nipples and stomachs. During his 22-year teaching career, many parents requested their children be in his class and some even asked him to tutor their kids or spend time with them outside of school because of the positive influence he had on them, he testified. Martin said he treated his students like family and developed closer relationships with some of his students. That was the case for two boys whose mother died and who would frequently come to Martin’s house to have dinner with him and his wife, he testified. During the many hours the two boys spent with him and his wife, he probably took “hundreds and hundreds” of pictures of them, including photos where one of the boys was shirtless, he testified. He also spent time outside of school with other male students, taking them bowling or going to their homes to bring birthday presents, he testified.

But while he developed deeper bonds with some students, the teacher testified, he told all of his students he loved them and signed off letters to the entire class with “Love.” With less than an hour for cross-examination this afternoon, Deputy District Attorney Derek Butts focused on another set of letters written by Martin that were addressed to God. In one letter, shown to the jury early on in the trial, Martin wrote, “Dearest Father, Before this, I was living for myself only, I was living to gratify me, serve me and feed my sinful desires… Please God, help me to not get arrested, not go to jail, and in the name of Jesus, not be charged with any crimes.” Another letter written by Martin and displayed in court today read, “I felt evil today. I felt the darkest demons of hell being entertained in my head.”

Martin testified today that he was inspired to write the letters after his wife gave him a book entitled Jesus Calling and considered them an outlet after learning from a parent that students were accusing him of inappropriate touching. He said the “sinful desires” he wrote about referred to his desire to be better than other teachers as well as his feelings of “severe depression.” The defendant also testified that Internet searches found on his home computer such as “definition of molestation,” “what if you are falsely accused?” and “Is a chest a private area of a boy?” were entered only after he learned of the pending allegations against him. Clancy has said that the charges against his client stemmed from school gossip that led to “mass hysteria” and false accusations. Martin’s testimony is expected to continue tomorrow, along with attorneys’ closing statements.

Former Auto Body Shop Owner Gets Probation and 30-day Home Detention for Insurance Fraud

The former owner of a Vallejo auto body shop was sentenced this month for automobile insurance fraud, the California Department of Insurance said today. Armand Eulano, 45, former owner and operator of G Collision in Vallejo, was convicted in Solano County Superior Court after pleading no contest to three felony counts of insurance fraud, the California Department of Insurance said.

Eulano billed Farmers Insurance for work he did not perform by cutting corners on bodywork and repairing parts instead of replacing them as agreed by the insurer, the Department of Insurance said. The fraud came to light when Farmers Insurance did a random re-inspection of 11 vehicles that had been repaired at Eulano’s body shop, Department of Insurance spokeswoman Madison Voss said.

The Farmers Insurance inspection disclosed some of the vehicles had only been patched and painted despite Eulano’s claim he replaced the damage with a new part. Eulano received payment for the higher repair cost, the Department of Insurance said. The fraudulent billing happened between late 2009 and August 2010, Voss said. Farmers Insurance then referred the case to the Department of Insurance. Eulano, who also was charged with grand theft, was sentenced July 10 to probation and 30-day home detention and was ordered to pay $40,000 restitution, the Department of Insurance said.

Suspect in Stolen Truck Tackled by Firefighters in San Francisco

A man who stole a truck from a construction site in San Francisco’s Lower Haight neighborhood this morning left a trail of damaged cars along a circuitous route to City Hall, where he was tackled by firefighters, police said. The man in his 20s was taken into custody at about 10:30 a.m. when a fire engine crew that happened to be in the area of Polk and Grove streets stopped him, fire spokeswoman Mindy Talmadge said.

The man had stolen a truck from a construction site near the corner of Laguna and Haight streets and hit multiple vehicles as he took off, police spokesman Officer Gordon Shyy said. He went by the Tower Car Wash at the corner of South Van Ness Avenue and Mission Street, then drove the wrong way up 11th Street, where he was spotted by police, Shyy said. Police followed him to the corner of Polk and Grove near City Hall and tried to pull him over.

The suspect jumped out of the car there and tried to run, but the fire crew tackled him and police took him into custody, Shyy said. The man, who has not yet been identified, could face charges of hit-and-run, driving a stolen vehicle and possibly reckless driving, Shyy said. No one was hurt during the incident.

Erica Bryan Vallejo woman killed allegely by Daryl Wakefield on Marin Street

A Vallejo woman killed early Saturday morning in an attack that also left her 5-year-old son injured has been identified as 40-year-old Erica Bryan, according to police. Bryan and her son were found in a home on the 2000 block of Marin Street, west of Sonoma Boulevard, after a 1:52 a.m. call Saturday reporting an assault, a police official said.

They were injured from an apparent violent attack, police said. The boy was taken to the trauma center of a Bay Area hospital where he was stabilized and is expected to survive his injuries, police said. Bryan was transported from the scene for emergency treatment but she died on the way to a hospital, he said. Detectives arrested a suspect in the attack, Vallejo resident Daryl Wakefield, 43, later that morning in East Vallejo.

He was arrested on suspicion of attempted murder and murder, police said. Police said that Wakefield knew the female victim. Wakefield is on parole for a burglary conviction and has a violent criminal history, according to police.

Hayward Police Bomb Squad, SWAT Team Find Nothing in Search of Home Under Eviction

A police SWAT team and bomb squad searched a Hayward home where sheriff’s deputies tried to evict the residents Monday morning but found no bombs or residents, police and sheriff’s officials said. Alameda County sheriff’s deputies found threatening notes indicating there was a bomb inside a residence in the 2700 block of Gainesville Avenue when they tried to serve an eviction notice just before 10 a.m. Monday, authorities said.

The SWAT team and bomb squad were called to the scene and remained there through the afternoon, eventually sending a robot inside to look for the bombs. The Hayward police SWAT team went in as well and was unable to find any bombs or people, sheriff’s Sgt. J.D. Nelson said. Nelson said they left the area at about 5:30 p.m.

3 Burglary Suspects Found Hiding in Hayward Business’s Attic

Three burglary suspects were arrested after they were found hiding in a Hayward business’s attic early Monday morning, police said. Police responded to the business in the 22000 block of Foothill Boulevard at about 5:30 a.m. after a burglar alarm went off. The arriving officers were told that voices and power tools were heard inside the business, police said.

The officers surrounded the business and ordered the suspects to come outside but received no response. The police went inside and searched the business and found three suspects hiding in the attic and arrested them, police said. They found one of the suspects carrying the business’s property.

The three suspects were identified as Victor Manuel Cruz, 25; Ariel Dominguez-Toledo, 40; and Jose Montana-Gonzalez, 33. All three are transients, police said. Anyone with information regarding this incident has been asked to contact Detective Jason Mosby at (510) 293-7034.

Florida mother arrested after allowing 7-year-old son to walk alone to park

A Florida woman who let her 7-year-old son walk alone to a park has been charged with felony child neglect. She said she felt he was mature enough to go to the park on his own. She said he has a cell phone he uses to check in with her. She could get jail time for this charge. There is controversy if this was truly a crime.

San Jose Police Disbanding Motorcycle Traffic Squads

The San Jose Police Department will reportedly be disbanding their motorcycle traffic units and transferring the officers to regular patrol duties. The department says it is necessary to fill the dwindling ranks of officers available to respond to 911 calls.

Video of wanted burglar in Alamo on Neely Court ID needed

The Contra Costa County Sheriff’s Office today asked for the public’s help in identifying a suspect involved in a residential burglary earlier this month in Alamo. The burglary occurred on July 5 at a residence in the 500 block of Neely Court. (story continues below video)

Detectives said the suspect, described as a younger white male driving a black SUV, parked his vehicle in the driveway and entered the residence through a back window. The suspect took several items including electronics, utensils and jewelry, according to the sheriff’s office.

In all, the suspect stole more than $12,000 in property. Investigators said the suspect might also have been involved in other burglaries in the Alamo area.

A man who was tackled by firefighters near San Francisco City Hall after stealing a truck from a construction site in the city’s Lower Haight neighborhood Wednesday morning and leaving a trail of damaged cars in his wake was identified as 21-year-old Tyrell Duncan, police said today. Duncan was booked into jail on suspicion of possessing a stolen vehicle, felony evading police, assault with a deadly weapon, multiple counts of hit-and-run, driving without a license, possession of drug paraphernalia, and multiple traffic infractions, police Officer Gordon Shyy said.

He was arrested at about 10:30 a.m. when a fire engine crew that happened to be in the area of Polk and Grove streets stopped him, fire spokeswoman Mindy Talmadge said. Laura Wenke Gets Prison for Stabbing Estranged Husband

A woman convicted of trying to kill her estranged husband by stabbing him at the business they owned in Redwood City in 2011 was sentenced this morning to 11 years to life in prison, San Mateo County District Attorney Steve Wagstaffe said. Laura Wenke, 53, was convicted in June by a San Mateo County Superior Court in Redwood City of attempted murder, inflicting great bodily injury, assault with a deadly weapon and felony domestic violence, prosecutors said.

Wenke and her husband were in the middle of a bitter divorce when on Sept. 15, 2011, she showed up at the construction business they owned together dressed in a mechanic’s jumpsuit with bubblewrap wrapped around her body underneath the jumpsuit, prosecutors said. Wenke parked her truck in front of the business and looked at her husband through the window. She walked up to him as he was working at a computer and used a stun gun on him, then stabbed him in the chest and neck, prosecutors said. He was hospitalized for several days to be treated for his injuries.

Wenke was arrested at the business by police responding to the stabbing. Wenke and her husband, then 48, had an 8-year-old son together and her husband had a $2 million life insurance policy with Wenke named as the beneficiary, prosecutors said. Her husband at one point made a statement to the court saying that he was confident that the stabbing was motivated by anger and money and that Wenke fully intended to kill him, Wagstaffe said.

Wenke attempted to argue that she was mentally ill at the time of the stabbing, but the jury rejected that defense and in sentencing her, Judge Stephen Hall said they were correct to do so, Wagstaffe said. Hall sentenced Wenke to nearly the maximum allowable sentence — which would have been 13 years to life in prison. Wenke will be eligible for parole after nine years, prosecutors said.

David Maurice Gomez Serving Life in Prison Kills His Prison Cellmate Franklin Feliz

A state prison inmate was convicted on Tuesday of first-degree murder for killing his cellmate, as well as separate assaults with a deadly weapon on other inmates, Monterey County District Attorney Dean Flippo said.

David Maurice Gomez, 48, was serving a term of 91 years and eight months to life at Salinas Valley State Prison for the crimes of forcible rape, two counts of forcible oral copulation, and first-degree residential burglary, according to Flippo.

On May 16, 2005, Gomez strangled his cellmate of two days until his voice box was crushed, beating him so severely that his face caved in and cutting him on the neck, forearm and wrist with makeshift weapons. Officers found the victim’s body in the back of the cell, prosecutors said. Gomez later made a comment to a prison staff psychologist that since he was serving a life sentence already, this murder was a “freebie,” according to Flippo.

On February 18, 2009, Gomez slashed another inmate across the neck with a small piece of razor during the recess of a court hearing, causing the injured inmate to receive seven stitches at Salinas Valley Memorial Hospital. Gomez.

On April 14, 2009 attacked a third inmate while both were receiving dental care. Gomez jumped out of his chair, ran across the treatment room and stabbed the inmate in the chest with another makeshift weapon.

Since 2005, eight different attorneys have represented Gomez.

From 2005 to 2013, assertions were made that he was too mentally ill to withstand trial, but in 2013 a Monterey County jury found him fit to stand trial, Flippo said.

Gomez now faces a maximum sentence of three additional life sentences consecutive to the sentence he is currently serving.

Hugh Leslie Baras Berkeley psychologist sentenced in tax evasion

A Berkeley man was sentenced today to more than two years in prison for tax evasion and theft of government property, prosecutors said. Hugh Leslie Baras, 70, has been sentenced to 30 months in prison and ordered to pay restitution of $593,513 to the Internal Revenue Service and the Social Security Administration, according to United States Attorney Melinda Haag and IRS agent Jose Martinez. Baras, a Berkeley psychologist, was convicted Feb. 3 of five counts of tax evasion and one count of theft of government property.

Prosecutors said Baras worked at Stanford University School of Medicine when he started a private practice in Palo Alto in 2002. Prosecutors said Baras omitted all of the income produced by this practice from 2005 to 2009 and collected disability insurance from the Social Security Administration despite earning a substantial income. The payments totaled $80,615. Prosecutors also said Baras sold nearly $600,000 worth of gold and silver coins to a broker in Oakland during this period, but he failed to report the capital gains on his tax returns.

Suspect in armed robbery of a convenience store in Brentwood ID Needed

Police are looking for the public’s help in identifying a suspect in the Wednesday armed robbery of a convenience store in Brentwood. Brentwood police said the suspect, described as a Hispanic male in his late 20s, robbed a local convenience store using a small-caliber handgun.

Police said the suspect has a shaved head, is about 5-foot 8, 180 to 200 pounds and has multiple tattoos, one of which appears to be of an “EW” on his chest. There were no reported injuries in the robbery. The suspect is considered armed and dangerous. Police said four other suspects involved in the robbery have been taken into custody.

Andrew Ceballos arrested for fatal shooting of Willie Troy Johnson, of Vallejo

Vallejo police have made an arrest in a fatal shooting that occurred earlier this month, officials said today. The shooting was reported on July 14, 2:20 p.m. in the 400 block of Capitol Street, according to Capt. James O’Connell. Responding officers found a male gunshot victim, later identified as 44-year-old Willie Troy Johnson, of Vallejo, O’Connell said. Johnson was taken to a hospital for treatment but later died of his injuries. Investigators identified a suspect and on July 27 they took Vallejo resident Andrew Ceballos, 24, into custody. He was booked into Solano County Jail. s

The Phoenix Police Department is asking for the public’s help to identify the suspect in this video. According to detectives, this suspect allegedly got into a shootout with an off-duty police officer who was managing the convenience store.

Surveillance cameras caught the robbery on video and shows two young children caught in the crossfire as the store owner and armed suspect exchanged gunshots.

Fortunately, no one was injured.

A man suspected of groping and kissing two women earlier this month has been arrested, Palo Alto police said today. The first incident occurred on July 11 around 11:30 a.m. in the College Terrace neighborhood. According to police, a woman in her 30s reported that a man at Werry Park and Dartmouth Street approached her, and aggressively touched and kissed her before she was able to shove him away.

On July 22, a woman in her 20s reported that she was the victim of a similar crime on the Stanford campus. The man in that incident approached the victim, asked about her marital status, and invited her to sit next to him on a bench. Police say that when the woman refused to sit and began to walk away, the man reached out for a handshake. Wanting to be polite, the woman took his hand. But when she did, police report the man used it to bring the woman close and lean in to kiss her. When the victim shoved the man’s face away from hers, he reportedly left the scene on foot.

Ahmad Esfandyarpour, 58, was arrested later that day on suspicion of misdemeanor battery in connection with the Stanford incident, according to police. After his arrest, police were able to link him to the July 11 incident, and Palo Alto detectives arrested him in connection with that attack on Thursday, police said. Angela Zuniga Wanted For Alleged Murder of 14-Year-Old Boy in Salinas Arrested in Mexico

A fugitive involved in the stabbing death of a Salinas 14-year-old was arrested in Mexico on Wednesday, police said. Angela Zuniga was sought by Salinas police for her role in the stabbing of purported gang member Ricardo Ruiz on May 17, 2013.

Zuniga confronted Ruiz at the intersection of East Alisal Street and North Madeira Avenue and asked what gang he was affiliated with. When he answered, Zuniga allegedly stabbed Ruiz in the neck, according to police. A citizen attempted to save Ruiz by transporting him to Natividad Medical Center, but he later died after his family decided to take him off life-support.

Police obtained information that Zuniga had fled to Mexico immediately after the stabbing. Salinas police requested the help of the U.S. Marshals Service to assist in the investigation. Mexican authorities were able to apprehend Zuniga in Tijuana and turn her over to U.S. Marshals custody at the San Ysidro Port of Entry, where she was booked into Las Colinas Detention Center to await extradition back to Monterey County.

“This is an example of how close cooperation between local, state, federal and foreign law enforcement are apprehending fugitive gang members who think they can operate with impunity in the Salinas community,” U.S. Marshal Donald O’Keefe said. A second suspect in the stabbing, Leslie Denise Rico, 23, was arrested in connection with the stabbing on June 17, 2013, after she saw her photo distributed by police.
